2015년 7월부터 뉴욕시에서는 특정 발포 폴리스티렌(EPS) 품목의 판매 또는 사용이 금지됩니다. 이 금지조상에는 2015년 7월 1일부터 2016년 1월 1일까지의 유예기간이 포함되어 있습니다. 유예기간 후에는 위반 통지서가 발부 될 것이며 민사 소송에 착수할 수 있습니다.
 
금지품목
1. 컵, 그릇, 접시, 테이크아웃, 쟁반 등 1회용 폴리스티렌 폼 품목
2. 폴리스티렌 충전 포장재(흔히 땅콩 포장재라고 알려짐).
   예외:
    1. 요식업소, 이동식 식품 매점, 또는 상점에서 수령하기 전에 충전 및 봉인된 사전 포장 식품에
       사용된 발포 폴리스티렌 용기
    2. 육류 냉장 진열대 또는 유사한 소매점용 가전제품에서 꺼내 판매되는 날고시, 되지고기, 생선,
       해산물, 또는 가금류를 저장하는 데 사용된 발포 폴리스티렌 용기.
    유의사항 : 배송 시 보오용 포장재로 사용되는 폼 블록은 이 법의 적용을 받지 않습니다.
 
 적용대상 비즈니스
이 금지조항은 EPS를 판매하거나 사용하는 비즈니스(뉴욕시 5개 보로 내에 위치하고 있거나 뉴욕시 5개 보로내에서 운영) 모두에 적용됩니다.
 
준수 방법
ㅇ2015년 7월 1일부터는 위에 나와있는 금지품복 중 어떠한 것도 판매하거나 사용하지 마십시요
ㅇ곤란 근거 면제를 신청하려면 – nyc.gov/foampackagingwaiver
​세부사항: 연간 수익(revenue) $500,000 미만의 비영리 및 (체인의 일부가 아닌) 소기업은 EPS로 제조되지 않은 대체 제품 구입으로 인해 과도한 재정적 곤란이 초래될 것이라는 것을 증명할 수 있는 경우, 소기업서비스부(SBS)에 곤란 근거 면제(hardship exemption)를 신청할 수도 있습니다. SBS는 2015년 여름에 곤란 근거 면제 신청 접수를 시작할 것 입니다.

대체 포장재
​종이, 플라스틱, 알루미늄, 생분해성 제품 등 많은 대체 포장재가 존재합니다. 폼 제품 대체품에 대한 정보를 원하는 경우 귀하의 포장재 유통업체에 연락하십시오.

Foam Packaging Restrictions

Beginning in July 2015, certain expanded polystyrene (EPS) items will be banned from sale, distribution, or use in NYC. This provision includes a grace period lasting from July 1, 2015 until January 1, 2016. Following the grace period, Notices of Violation will be issued and civil action may be taken.

 

Banned Items

1. Polystyrene foam single-service items including cups, bowls, plates, takeout containers, and trays.

2. Polystyrene loose fill packaging, commonly known as packing peanuts.

Exceptions:

1. Expanded polystyrene containers used for prepackaged food that have been filled and sealed prior to receipt by the food service establishment, mobile food commissary, or store.

2. Expanded polystyrene containers used to store raw meat, pork, fish, seafood or poultry sold from a butcher case or similar retail appliance.

Note: Foam blocks used as protective packaging in shipping are not covered under this law.

 

Affected Businesses, Agencies, & Institutions

This ban affects any business, agency, or institution that sells or uses EPS and is located or operates within any of the 5 boroughs of New York City.

 

HOW TO COMPLY

•Effective July 1, 2015, do not sell or use any banned items as described above.

•To apply for a Hardship Waiver – nyc.gov/foampackagingwaiver

Details: Nonprofits and small businesses (not part of a chain) with less than $500,000 in revenue per year may apply for hardship exemptions from the Department of Small Business Services (SBS) if they can prove that the purchase of alternative products not composed of EPS would create undue financial hardship. SBS will begin accepting applications for hardship waivers in the summer of 2015.

 

ALTERNATIVES

There are many alternative packaging options available including paper, plastic, aluminum, and biodegradable products. Contact your packaging distributor about alternatives to foam products.
